Privacy policy
1. Our privacy commitment
We comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. When we deal with people in New Zealand we also follow the Privacy Act 2020 (NZ) and its Information Privacy Principles. For people in the United States, we follow the privacy laws that apply to us.
We collect only what we need to quote, make and deliver your order, and to keep in touch with you if you ask us to. We do not sell personal information.
2. What we collect
- Contact details: your name, organisation, role, email address, phone number and delivery or billing address.
- Enquiry and order details: garments, quantities, sizes, dates, artwork and logo files, and notes you send us.
- Account and transaction records: quotes, orders, invoices and payment status. Card payments are handled by our payment provider, and we do not store full card numbers.
- Marketing preferences: whether you have subscribed to our emails, and how you respond to them.
- Website and device data: IP address, browser and device type, pages viewed, referring site or ad, and the time of your visit, collected through cookies and similar tools (see section 7).
- Job applications and franchise enquiries: the information you choose to send us.
We don’t ask for sensitive information, such as health information, and ask that you don’t send it to us. You can deal with us without giving your name for general questions, but we need your contact details to quote or supply an order.
3. How we collect it
Most information comes directly from you, through our website forms, email, phone, social media messages, our showrooms and our client ordering portals. We may also receive your details from your organisation (for example, when a colleague places an order for your team), from advertising platforms when you submit a lead form, or from public business sources such as company websites and LinkedIn.
4. How we use it
- Respond to enquiries, prepare quotes and mockups, and process, produce and deliver orders.
- Manage your account, invoicing and payments.
- Provide customer service and after-sales support.
- Send you updates, new ranges and offers, if you have subscribed. Every marketing email has an unsubscribe link.
- Measure and improve our website, advertising and services.
- Meet our legal, tax and accounting obligations, and prevent fraud or misuse.
5. Automated tools and decisions
We use software to sort and route enquiries. For example, a website enquiry is created as a lead in our sales system and allocated to a team member. Our team may also use AI tools to help draft quotes, mockups or replies, and a person reviews that work before it is sent.
We do not use computer programs to make decisions about you that significantly affect your rights or interests, such as credit or account decisions, without a person being involved. If that changes, we will update this policy to describe the decisions and the kinds of personal information used, as the Privacy Act requires.
6. Who we share it with
We share personal information only as needed to run our business, and we require our providers to protect it. This includes:
- Decorators, manufacturers, garment suppliers and freight carriers who make and deliver your order.
- Our business systems: our CRM and marketing platforms (such as HubSpot and Mailchimp), our order and production system (ShopVOX), integration tools (such as Zapier), email and file storage (Google Workspace), and accounting and payment providers.
- Our OCC team members and contractors, including our support team in the Philippines, and OCC teams in New Zealand and the United States.
- Advertising and analytics providers such as Google and Meta (see section 7).
- Our professional advisers, and government authorities where the law requires it.
7. Cookies, analytics and advertising
Our website uses cookies and similar technologies to make the site work, remember your preferences, measure visits (Google Analytics, via Google Tag Manager), track enquiries (HubSpot), and measure and show our advertising (for example, Google Ads and Meta). Embedded videos are played through YouTube’s privacy-enhanced mode.
You can block or delete cookies in your browser settings, and opt out of personalised ads through your Google and Meta ad settings. Some parts of the site may not work properly without cookies.
8. Storing and sending information overseas
We operate in Australia, New Zealand and the United States, and many of our systems are cloud-based. Your information may be stored or accessed in Australia, New Zealand, the United States, the Philippines, the European Union and other countries where our providers operate.
Before we disclose personal information overseas, we take reasonable steps to make sure it will be handled consistently with Australian privacy law, for example through contract terms and by choosing reputable providers.
9. Keeping it secure
We protect personal information with access controls, named user accounts, two-factor authentication on key systems and reputable cloud providers. We keep information only as long as we need it for the purposes above or to meet legal and tax record-keeping rules, then delete or de-identify it.
If a data breach is likely to cause serious harm, we will notify you and the relevant regulator as required under the Notifiable Data Breaches scheme (Australia) or the Privacy Act 2020 (NZ).
10. Your choices and rights
- Access and correction: ask for a copy of the personal information we hold about you, or ask us to correct it.
- Marketing: unsubscribe from our emails at any time with the link in each email, or by contacting us.
- Deletion: ask us to delete your information where we no longer need to keep it.
- United States visitors: depending on the state you live in, you may have extra rights, such as to know, delete or correct your information, or to opt out of targeted advertising. Email orders@occapparel.com.au to make a request. We will not treat you differently for using these rights.
We respond to requests within 30 days. We may need to confirm your identity first. Access is free, although we may charge a reasonable fee for large requests where the law allows.
11. Questions and complaints
To ask a question, make a request or raise a complaint, email our Privacy Officer at orders@occapparel.com.au, use our contact page, or write to: Privacy Officer, Outdoor Clothing Concepts Pty Ltd, 11/7 Traders Way, Currumbin QLD 4223, Australia.
We aim to resolve complaints within 30 days. If you are not satisfied with our response, you can contact the Office of the Australian Information Commissioner (oaic.gov.au) or, in New Zealand, the Office of the Privacy Commissioner (privacy.org.nz).
